Terms of service

These terms are an agreement between you and Greg Stenger, doing business as StopSmith (“we”). By creating an account or using StopSmith, you agree to them. If you use StopSmith for a business, you agree on its behalf.

1. What StopSmith does

StopSmith is a planning tool. It shows your appointments from the calendars you connect, estimates drive times between them, and tells you whether a new appointment is likely to fit.

Its answers are estimates. Drive times come from map data and can be wrong because of traffic, weather, road work, parking or bad addresses, and connected calendars can be out of date or incomplete. You make the final decision about which appointments to accept and when to leave, and you're responsible for driving safely and following traffic laws. Don't use StopSmith while driving.

2. Your account

• You must be at least 18 years old.
• Give accurate information and keep your password safe. You're responsible for activity on your account.
• Tell us promptly at support@stopsmith.com if you think someone else has used your account.

3. Rover, Google and other services

StopSmith is not affiliated with, endorsed by or sponsored by Rover or Google. It reads the calendar Rover provides to you and, if you choose, your Google Calendar. It never changes your Rover calendar; it changes your Google Calendar only when you add, edit or delete an event in StopSmith, and you're responsible for those changes. Your use of those services is governed by their own terms, and they can change or stop their calendar features at any time, which may affect StopSmith.

You agree not to use StopSmith to move bookings off Rover or any other platform whose terms require bookings, payments or client relationships to stay on that platform, and not to use it to get around a platform's fees or rules. StopSmith doesn't offer booking, payments or client messaging.

4. Your information and your clients' information

You keep ownership of everything you put into StopSmith or connect to it. You give us permission to store, process and display it only as needed to run StopSmith for you, as described in our privacy policy.

StopSmith stores information about your clients, such as their names and home addresses. You confirm that you have the right to use that information for planning your work, and you agree to handle it lawfully and keep it confidential.

5. Acceptable use

Don't:

• break the law or anyone else's rights, including privacy rights, using StopSmith;
• try to access other people's accounts or data, or get around StopSmith's security;
• overload, scrape or reverse engineer StopSmith, or use it to build a competing product;
• connect calendars or enter information you don't have the right to use.

6. Subscriptions and billing

• Some features need a paid subscription. Prices, billing periods and any free trial are shown before you subscribe. Prices don't include sales tax, which is added at checkout where the law requires it.
• Subscriptions renew automatically at the end of each billing period until you cancel. If your subscription starts with a free trial, you'll be charged when the trial ends unless you cancel first.
• You can cancel at any time from your account. Cancelling stops future charges; you keep access until the end of the period you've paid for. Payments aren't refunded except where the law requires it.
• We may change prices with at least 30 days' notice. A new price applies from your next billing period after the notice.
• Payments are processed by Stripe, under Stripe's terms.

Referrals

• You can share your referral link with people you know. When someone creates an account through your link within 60 days and first pays for a subscription, you earn one free month: a credit equal to one month's price on your next bill if you're subscribed, or 30 more days of access if you aren't. One reward per person referred.
• You can't refer yourself or earn rewards through accounts you control. Don't send your link in unsolicited messages, and don't send it to clients through Rover or other platforms whose rules forbid it.
• Rewards have no cash value and can't be transferred. We may withhold or reverse a reward we believe was earned against these rules, and we may change or end the referral program with notice on this page; rewards already earned stay yours.

7. Changes and availability

We work to keep StopSmith running, but we don't promise it will always be available or free of errors. We may change, add or remove features. If we make a change that significantly reduces what a paid subscription includes, we'll tell you in advance and you can cancel.

8. Ending your use

You can stop using StopSmith and delete your account at any time. We may suspend or close your account if you break these terms or if we need to for legal or security reasons; where reasonable, we'll tell you first and give you a chance to fix the problem. If we stop offering StopSmith altogether, we'll give you at least 30 days' notice and a refund for any prepaid period you can't use.

9. Disclaimers

To the extent the law allows, StopSmith is provided “as is” and “as available,” without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

10. Limit on liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, bookings, clients or data, arising from your use of StopSmith, including missed or late appointments. Our total liability for any claim about StopSmith is limited to the greater of the amount you paid us in the 12 months before the claim and $50. Some places don't allow these limits, so they may not all apply to you.

11. Your responsibility to us

If someone makes a claim against us because of information you put into StopSmith, or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim.

12. Law and disputes

These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Georgia, and you and we agree to those courts' jurisdiction. Before filing a claim, please email us at support@stopsmith.com so we can try to resolve it informally.

13. Changes to these terms

We may update these terms. We'll change the date at the top, and if a change is significant we'll tell you in StopSmith or by email at least 14 days before it takes effect. If you keep using StopSmith after that, the new terms apply.

14. Everything else

These terms and our privacy policy are the whole agreement between you and us about StopSmith. If part of them can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it. You can't transfer your account or these terms without our permission; we may transfer them as part of a merger or sale of the business.
